Terms of use

Last updated: 17 October 2026

This text is a draft prepared for Rentoth. It must be reviewed by a lawyer registered in Morocco before it is relied on.

These terms govern the use of Rentoth, the software published by Othmane TIBARI (www.rentoth.com), by car rental agencies and the people they authorise. By using the Service or subscribing to it, the agency accepts these terms.

The agency's own customers, who book a car on an agency website, deal with the agency and not with Rentoth. The agency's rental conditions apply to them.

1. Definitions

  • "Service": the Rentoth dashboard, the agency websites, the contract and signature tools, and the related features, provided online.
  • "Agency": the business that subscribes to the Service to manage its car rental activity.
  • "User": any person the Agency gives access to its account (owner or staff).
  • "Renter": a customer of the Agency, whose data the Agency records in the Service.
  • "Content": the data, texts, photos and documents the Agency puts into the Service.

2. Account and access

Accounts are opened by Rentoth after an exchange with the Agency. The Agency gives accurate information and keeps it up to date.

Each User has personal credentials and keeps them confidential. The Agency is responsible for what is done under its Users' accounts and tells Rentoth without delay about any access it did not authorise.

3. The Service

Rentoth provides the Service as it exists at the time of use, and improves it over time. Rentoth does its best to keep the Service available at all times, but does not guarantee uninterrupted access: maintenance, updates and incidents outside its control can interrupt it. Planned maintenance is announced in advance where possible.

Rentoth does not rent cars, does not take part in the rental contract between the Agency and the Renter, and does not collect payments on the Agency's behalf.

4. Price, invoices and payment

The Agency chooses its plan and payment cycle (monthly or yearly). The price is the one in the price list published on the pricing page on the day of subscription, or the launch price stated in the confirmation sent to the Agency. There is no setup fee. Any price increase is announced at least 60 days in advance, never applies to a period already paid, and the Agency may terminate at no cost before it takes effect. Prices are in Moroccan dirhams. Payment is made by bank transfer, and each payment is acknowledged by a payment confirmation.

An option priced per unit, such as each tracker sent directly to Rentoth's tracking server, is added to the subscription price, at the price shown on the pricing page and accepted by the Agency in its dashboard when it turns the option on. The rules above on price increases apply to it.

5. The Agency's obligations

The Agency uses the Service lawfully and in line with these terms. In particular, it is responsible for:

  • the accuracy of the cars, prices, availability and conditions it publishes, and their compliance with the law, including loi 31-08 on consumer protection;
  • its rental conditions, contract terms, insurance and any authorisation its activity requires;
  • the lawfulness of the Renters' data it records, and informing Renters about how it uses their data;
  • holding the rights to the photos, logos and texts it publishes;
  • not attempting to access other agencies' data, disrupt the Service, or use it to send unsolicited messages.

6. Contracts and electronic signature

The Service lets the Agency prepare rental contracts and have them signed electronically on a secure link. The signature is recorded with its date, the IP address it was made from and a fingerprint of the signed content, and the signed contract can no longer be changed.

Under Moroccan law (loi 53-05 on the electronic exchange of legal data, and loi 43-20 on trust services for electronic transactions), an electronic document can be used as evidence when the person who signed it can be identified and the document is kept in conditions that guarantee its integrity.

The signature offered by the Service is a simple electronic signature. It does not rely on a certificate from an accredited provider and does not benefit from the presumption of reliability attached to a qualified signature. The Agency remains responsible for checking the Renter's identity, for the content of its contracts and for deciding how it relies on them. Rentoth does not give legal advice.

7. Personal data

For the data of its Renters, the Agency is the controller: it decides why the data is processed and by what means, and Rentoth processes it only on the Agency's behalf. For the account, sign-in and security data of its Users, Othmane TIBARI is the controller, as described in the privacy policy.

When it processes data on the Agency's behalf, Rentoth acts only on the Agency's instructions, keeps the data confidential and applies the security measures described in the privacy policy, as loi 09-08 requires of a processor. The people at Rentoth who access the data are bound by the same confidentiality. The photos of a returned car may be deleted after a period set by Rentoth, never less than twelve months after the end of the rental, as the privacy policy states.

Renters' data, including ID and driving licence numbers, is hosted by the providers listed in the privacy policy, some of them outside Morocco. The Agency completes the formalities loi 09-08 requires with the CNDP for its own processing, and covers these transfers and the processing of ID numbers in its declaration or authorisation request.

Geolocation of vehicles is the Agency's own processing. Before using it, the Agency obtains its prior authorisation from the CNDP, switches on the geolocation clause so that Renters are told in their contract, uses trackers approved by the ANRT, and gives Rentoth a read-only access to its tracking platform, or registers its trackers on Rentoth's tracking server. Rentoth reads that data on the Agency's behalf, never sends a command to a vehicle, and offers no security or recovery service.

8. Intellectual property

The Service, its software, its design and the Rentoth brand belong to Othmane TIBARI. The Agency receives a personal, non-transferable right to use the Service for the length of its subscription.

The Agency keeps all rights to its Content. It allows Rentoth to host, copy and display that Content only as far as needed to provide the Service, including on the Agency's website.

9. Liability

Rentoth is bound by an obligation of means. It is not liable for indirect damage, such as loss of revenue or loss of customers, nor for damage caused by a use of the Service that does not follow these terms, nor for disputes between the Agency and its Renters, including those about vehicles, accidents or payments.

Where Rentoth is found liable, its total liability is limited to the amounts the Agency paid for the Service in the twelve months before the event, except in the case of gross negligence or wilful misconduct.

10. Duration and termination

The subscription runs for the period paid and renews for the same period unless either party ends it before the renewal date. The Agency can end it by writing to contact@rentoth.com.

Rentoth may suspend or end the account after notice if the Agency seriously breaches these terms, or without notice where required to protect the Service, its users or the law.

After the end of the subscription, the Agency can ask for an export of its data for thirty days. After that period, the data is deleted, except what the law requires Rentoth to keep.

The Agency remains responsible for keeping its contracts, their signing records, its invoices and its accounting records for the periods the law requires. It should ask for the export before the end of the thirty days.

11. Changes to these terms

Rentoth may update these terms. Agencies are told about any significant change at least thirty days before it applies. If the Agency does not accept the change, it can end its subscription before that date and is refunded the unused part of any period it has paid in advance. Otherwise, continuing to use the Service after that date means accepting the new terms.

12. Applicable law and disputes

These terms are governed by Moroccan law. The parties first try to settle any dispute amicably. If they cannot, the dispute is brought before the competent commercial court of Marrakech.

These terms are drawn up in French. The versions in other languages are provided for convenience; if they differ, the French version prevails.
